Terms of Service

Welcome to Gather! These Terms of Service ("Terms") govern your use of the Gather mobile application. By using Gather, you agree to these Terms. If you don't agree, please don't use the app.

1. Acceptance of Terms

By creating an account and using Gather, you agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old to use Gather.

2. Description of Service

Gather is a gathering planning application that helps you coordinate trips, events, and other group plans with friends. The service includes:

• Creating and managing gatherings
• Coordinating bring lists and packing
• Tracking shared expenses
• Posting updates and announcements
• Managing participant lists and carpools

3. User Accounts

Account Creation

Gather supports several ways to sign in: email and password, Sign in with Apple, Sign in with Google, or as a guest. You must provide accurate and complete information when creating your account, regardless of method, and you are responsible for maintaining the security of whatever credentials apply (your password, or your Apple ID / Google account if you used those to sign in). What we collect about you depends on the sign-in method — see our Privacy Policy for details.

Account Responsibilities

• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized access
• You may not share your account with others
• You may not create an account using false information

4. Acceptable Use

You agree NOT to use Gather to:

• Violate any laws or regulations
• Harass, abuse, or harm other users
• Post inappropriate, offensive, or harmful content
• Spam or send unsolicited messages
• Attempt to hack, reverse engineer, or compromise the app
• Scrape or collect user data without permission
• Impersonate others or create fake accounts
• Use the app for commercial purposes without authorization

5. User Content

Your Content

You retain ownership of content you post in Gather (gathering details, updates, photos, etc.). By posting content, you grant us a license to store, display, and distribute it as necessary to provide the service.

Content Standards

You are responsible for your content and must ensure it:

• Does not violate anyone's rights (copyright, privacy, etc.)
• Is not illegal, harmful, or offensive
• Does not contain malware or malicious code

Content Removal

We reserve the right to remove content that violates these Terms, but we are not obligated to monitor all content.

6. Financial Matters

You agree that:

• Gather is not responsible for payment disputes between users
• Expense tracking in the app is for informational purposes only
• You are responsible for settling debts with other participants
• We do not verify the accuracy of expense entries

7. Gathering Coordination

Gather is a coordination tool only. We are not responsible for:

• Actual gathering logistics, safety, or outcomes
• Disputes between gathering participants
• Lost or forgotten items on bring lists
• Accuracy of gathering information entered by users
• Carpool arrangements or transportation safety

8. Intellectual Property

Gather and its original content, features, and functionality are owned by Oleksandra Tkachenko and are protected by international copyright, trademark, and other intellectual property laws.

9. Third-Party Services

Gather uses third-party services (like Firebase). Your use of these services is subject to their respective terms of service. We are not responsible for third-party service issues.

10. Disclaimers

We do not guarantee that:

• The app will be error-free or uninterrupted
• Defects will be corrected
• The app is free from viruses or harmful components
• Your data will never be lost (though we make reasonable efforts)

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLEKSANDRA TKACHENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability shall not exceed $100 USD or the amount you paid to use Gather (currently $0), whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Oleksandra Tkachenko from any claims, damages, or expenses arising from:

• Your use of Gather
• Your violation of these Terms
• Your violation of any rights of others
• Content you post in the app

13. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harmful behavior toward other users
• Extended inactivity

You may delete your account at any time through the app settings or by contacting us. See our Data Deletion page for details.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of Gather after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of Gather shall be resolved through binding arbitration in Charlotte, North Carolina, except that you may bring claims in small claims court.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gather regarding use of the service.
